Criminalization of the Action of Submitting Criticism to The Government Based on The Electronic Information and Transaction Law in Indonesia, And Protection of The Right to Freedom of Speech in A Democratic Country

Indonesia as a democratic country guarantees the freedom for its citizens to express opinions. This is stated in Article 28 E of 1945 Constitution which states that everyone has right association, assembly and expression. The order laws regulations force must be line with mandate constitution. However, since enactment Law Number 11 2008 amended by 19 2016 concerning Electronic Information Transactions (hereinafter referred ITE Law), public feels there are restrictions expressing use social media increasing. Opinions criticisms also widely conveyed through media. Many / opinions then categorized hate speech, even insults. These elements offenses result perpetrators being subject criminal sanctions. study will examine criminalization act submitting criticism government based on protection expression country. research uses normative juridical methods, namely principles, legal principles rule law. data used, obtained literature study. law aims create conduciveness interaction cyber space, so it should not reach out criminalize all forms electronic information critical government. It still necessary limit submission internet media, where contain insults speech. In an ideal atmosphere, protect rights balanced way.
